Terms of Service
These Terms govern your use of Morphome — a web service that generates images and videos from your uploaded photos, drawings, sketches, plans, and text descriptions, using third-party AI models. By creating an account or using the service, you agree to these Terms.
Morphome is operated as an individual project from Ukraine. References to "we", "us", or "Morphome" mean the operator of the service. References to "you" mean the person using it.
1. Who can use Morphome
You must be at least 18 years old to use Morphome. If you're under the age required to consent to data processing in your country, you must have a parent or guardian's permission first.
You agree to provide accurate information when signing up and to keep your account secure. You're responsible for everything that happens under your account.
2. What you can upload
You can upload images and text for processing. By uploading, you confirm that:
- You own the content, or you have the right to use it (a license, the creator's permission, public-domain status, etc.).
- It doesn't infringe anyone's copyright, trademark, or other rights.
- It doesn't include identifiable real people without their consent.
- It doesn't contain illegal content — including but not limited to child sexual abuse material, content inciting violence or hatred, malware, or material that violates anyone's privacy.
- It doesn't attempt to bypass safety filters or generate prohibited content listed below.
You're solely responsible for what you upload. We may remove uploaded content and suspend accounts that violate these rules, without notice.
3. Prohibited content and use
You may not use Morphome to generate, request, or process:
- Sexual content involving minors, in any form.
- Non-consensual intimate imagery of real people ("deepfake nudes" or similar).
- Content that impersonates real people in misleading ways (fake quotes, fake events, fabricated evidence).
- Hateful, violent, or harassing content targeting individuals or groups.
- Content designed to defraud, mislead, or manipulate (fake documents, forged signatures, counterfeit designs).
- Anything that violates applicable law in your jurisdiction or in Ukraine.
You also may not: reverse-engineer the service, scrape it at scale, attempt to access other users' data, abuse the credit system, or use the service to build a competing AI product.
4. Generated content — who owns it
Subject to your compliance with these Terms, you own the output Morphome generates from your inputs. You can use, modify, publish, sell, license, or distribute generated images and videos — for personal projects, client work, commercial products, anything you like. We don't claim any ownership over your generations and don't require attribution.
That said, a few practical caveats apply:
- AI-generated content may not be copyrightable in some jurisdictions — that's a question of local law, not of these Terms. We don't make legal guarantees about copyright status.
- You're responsible for what the output depicts. If an AI model produces something that resembles a real person, a trademarked design, or copyrighted material — and you publish it — that's your responsibility to evaluate.
- We don't train models on your content. Your uploads and prompts are sent to AI providers for inference only. See the Privacy Policy for details on which providers we use.
5. Credits, purchases, and refunds
Morphome runs on a credit system. Credits are consumed by generations — the exact cost varies by output type (image vs. video), resolution, and other factors shown in the interface before you confirm a generation.
Credits have no cash value, can't be transferred between accounts, and don't expire unless your account is closed.
Refund policy:
- Consumed credits are non-refundable. Once a generation has been delivered to you, the credits used are not refundable — even if the result isn't what you expected. AI output is inherently variable; that's the nature of the tool.
- Unused credits may be refunded at our discretion if you request it through the contact page within a reasonable time after purchase. We aim to honour reasonable refund requests for unused balances.
- Failed generations are auto-refunded. If a generation fails for a technical reason on our end, the system returns the credits to your account automatically.
6. Service availability
We do our best to keep Morphome running smoothly, but we don't guarantee uninterrupted availability. The service depends on third-party AI providers, payment processors, and our own infrastructure — any of which can have outages.
We don't offer a Service Level Agreement (SLA) for free or trial use. Planned maintenance is announced where practical; unplanned outages happen.
7. Accounts, suspension, and termination
You can stop using Morphome and close your account at any time through your dashboard. When you close your account, your generation history and account data are deleted in line with the Privacy Policy.
We may suspend or terminate accounts that violate these Terms, including for repeated abuse of the safety rules, attempted bypassing of restrictions, fraudulent payment activity, or other serious breaches. In such cases, any remaining credits are forfeited and not refunded.
We may also discontinue specific features or the entire service with reasonable advance notice where practical.
8. AI output — important disclaimers
Morphome uses AI models to generate content. Please understand the following:
- Output is provided "as is". AI models can produce unexpected, inaccurate, biased, or low-quality results — sometimes despite filters and safety systems.
- We don't pre-review generations. Outputs are produced on-demand by automated systems. We don't manually review each one for quality or correctness.
- You must verify outputs before use. For any meaningful purpose — particularly commercial, legal, architectural, or safety-related — you're expected to review and verify the generated content yourself. Don't rely on Morphome output as authoritative.
- Occasional inappropriate results are possible. Safety filters reduce, but don't eliminate, the chance of unexpected content. If you encounter something genuinely concerning, please report it via the contact page.
9. Disclaimer of warranties; limitation of liability
To the extent permitted by applicable law, Morphome is provided "as is" and "as available", without warranties of any kind — express or implied — including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or special damages, or for lost profits, lost data, or business interruption arising from your use of the service. Our total cumulative liability for any claim relating to Morphome is limited to the amount you paid us in the twelve months preceding the claim, or €100 — whichever is greater.
Nothing in these Terms limits liability that cannot be limited under applicable law (such as for gross negligence, intentional misconduct, or, where applicable, statutory consumer rights).
10. Third-party services
Morphome relies on third-party services to operate — including AI model providers, payment processors, email delivery, and cloud infrastructure. Your use of Morphome involves data being processed by these providers as described in our Privacy Policy. We're not responsible for their independent acts, but we choose providers we consider reasonable and review them periodically.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. For material changes — anything that meaningfully affects your rights or how the service works — we'll notify registered users by email at least 14 days before the change takes effect, where reasonably practical.
Continuing to use the service after a change takes effect means you accept the updated Terms. If you don't agree with a change, you can close your account before the effective date.
12. Governing law and disputes
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or your use of Morphome will be resolved in the competent courts of Ukraine.
If you're a consumer based in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection rules, those mandatory protections still apply to you regardless of this clause.
13. Other
If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision at any time isn't a waiver of our right to enforce it later. These Terms, together with our Privacy Policy and Cookie Policy, are the complete agreement between you and us regarding the service.
